What the work involves
Mediation works best when the client understands the strengths, weaknesses and likely cost of the case before walking in. Preparation focuses on a realistic picture of the dispute and of what a satisfactory resolution would look like.
Arbitration is a private hearing whose decision is usually final. The case is prepared and presented much as it would be at trial, with evidence, witnesses and argument, in a forum the parties chose.
