When clients call

Real estate disputes are often between people who will stay neighbors, landlords and tenants, or lenders and borrowers. That makes an early, practical conversation especially worthwhile.

A neighbor dispute over a property line, an easement or the use of land.

A real estate purchase or sale has produced a claim after closing.

A buyer or seller says the other side failed to disclose a problem with the property.

A landlord and a business tenant disagree about what the lease requires.

A lender and borrower are in dispute over a loan secured by real property.

A lien has been recorded against a property and its validity is disputed.

What the work involves

Real estate disputes turn on the documents and on the land itself: deeds, surveys, title records, purchase contracts, leases, loan documents and the history of how the property has been used. The early work is gathering that record and establishing what it actually shows.

Because so many of these disputes are between people with an ongoing relationship, negotiation and mediation are often the best route. When a matter cannot be resolved that way, it is litigated.
